Terms and Conditions

The use of the UM6P Canada website (hereinafter the “Site”) implies full acknowledgement of the terms and conditions of access and use (hereinafter the “Terms of Use”) by the internet user (hereinafter the “User” or “Users”).

The term “Use” refers indiscriminately to any browsing, searching or downloading on the site. The terms “Publisher”, “UM6P” or “We” are used to designate UM6P, its schools and departments.

UM6P Canada reserves the right to modify and update the site and the terms of use at any time. Each modification of the terms of use will be the subject of a dated and referenced version. The new version may be consulted on the site. In this case, the last update indicated on the site will be amended.

Any modification takes effect immediately upon publication on the site. The user's continued use of the site following the publication of such changes shall constitute an acknowledgement thereof. These modifications and updates are binding on the user, who must therefore regularly refer to this section to check the current version.

UM6P Canada views recruitment as the first step in an integration process. Each position for which UM6P recruits requires specific selection steps. The objective being the same: to match the right candidate to the right position. The stages of the recruitment process will be defined and organized in a dedicated section/tab (currently under construction on the site).

Access to the site is free of charge, excluding the cost of Internet access providers and telephone communications, which are billed directly by telephone operators.

The information, presentations, documents and data (hereinafter referred to as the “Data”) communicated on the site are provided in good faith, for information purposes only and without guarantee of any kind, as errors and omissions may occur. UM6P Canada cannot be held liable for any errors or omissions. They may be modified or updated by UM6P Canada without notice.

The user is solely responsible for his/her use of the site. The user is deemed to have accepted the site's legal notices and the terms of use simply by consulting the site. Under no circumstances shall UM6P Canada or its departments be held liable for the completeness, imprecision or inaccuracy of the information, or any omission relating to the information, nor shall they be held liable for any direct and/or indirect damage, whatever the cause, origin, nature or consequences, whether fortuitous or otherwise, resulting from the content or use of the site and/or any of the links and addresses linked to it (including access or inability of users to access the site or any of these links. This includes any use that may be made of such Information), in particular, but not exhaustively, any operating loss, financial or commercial loss, loss of programs and/or data in the information system of the user.

The user fully assumes the risks associated with the importance and the reliance placed on the information. The information is provided to the user on the condition that he/she is able to determine its suitability for a particular purpose before using it. Under no circumstances will UM6P Canada be liable for any damages whatsoever resulting from the use of this Information, particularly for private or professional purposes. This information should not be construed as recommendations to use any information, product, procedure, equipment or formulation that conflicts with any patent, copyright or trademark.

UM6P disclaims any liability, express or implied, if the use of the information would infringe any patent, copyright or trademark. UM6P categorically rejects any interpretation that would seek to equate the content of the site with offers to purchase or inducements to purchase shares or other securities, whether listed or unlisted, of UM6P, its schools and direct or indirect subsidiaries. No warranty, express or implied, is given as to the merchantability of the inform

ation provided, or as to its suitability for any particular purpose, or as to the products or services referred to in such information. UM6P makes no commitment to update or correct the information published on the site.

UM6P reminds users that simulations that may be carried out on the site have no legal value. These simulations are based on information entered by users in the relevant modules, and are provided for information purposes only. UM6P Canada does not guarantee that the site will operate without interruption or that the servers providing access to it and/or third-party sites to which hypertext links appear are free of viruses. In addition, UM6P cannot be held responsible for any loss or damage to user data.

Users are informed that upon visiting the site, a navigation tracking mechanism may be implemented. They have the right to access, withdraw and modify personal data communicated by means of tracking techniques. When users visit the UM6P site, a session cookie (hereinafter referred to as “cookie(s)”) is created, which records information about their computer's browsing on the site (pages visited, date and time of visit, etc.), which UM6P Canada can read on subsequent visits.

During every browsing session, the pages viewed generate a session cookie that is downloaded to the user's computer. Cookies are small files containing text, which enable a server to recognize a computer and thus know whether the computer (and presumably the user) has visited the site previously. If the computer reconnects to the site, the latter will retrieve and make use of the cookies stored on the hard disk during the previous visit.

Cookies themselves do not identify a user, but merely the computer they are using. Cookies only record the sections accessed by the computer in question and the time spent. The user is free to disallow the recording of cookies by configuring the browser as described below. However, refusing cookies will make it impossible to provide certain personalized services, and may slow down or prevent access to some sections of the site.

The user is hereby informed that, when visiting the site, a cookie may be automatically installed on his/her browser and temporarily stored on the hard disk. This information is used to provide optimum service. Cookies are used to:

  • Record information on the user's browsing in order to direct the user to the most suitable content.
  • Measure the number of visits to the site.

Under no circumstances are cookies intended to be used to collect personal information on users.

The user acknowledges having been informed of this practice and authorizes UM6P Canada to implement it. The user may deactivate cookies by using the settings in their browser software, in particular by modifying the options in the browser software on their computer (“Edit/Preferences” in Netscape Navigator 6.2, “Tools/Internet Options” in Internet Explorer, “Tools/Options” in Mozilla Firefox and “Safari/Security” in Apple Safari).

UM6P Canada is the owner of all domain names relating to “UM6P Canada” and those of its departments. The site as a whole, together with its component parts, constitute intellectual works protected by the laws in force, in particular those relating to intellectual property.

All data, in particular text, tree structure, software, animations, photographs, illustrations, diagrams, graphic representations, logos, sounds, images, information and databases, where applicable, appearing on the site pages are the exclusive property of UM6P Canada. Any reproduction, representation or distribution, in whole or in part, of the content, as well as any extraction, even partial, of the site's databases on any medium or by any process whatsoever, is prohibited. Failure to comply with this prohibition constitutes an infringement liable to engage the civil and criminal liability of the infringer or the user.

Unless otherwise specified, the company names, logos, products and brands mentioned on the site (® and TM products) are registered trademarks of UM6P Canada. Any reproduction in whole or in part of these trademarks and logos for any purpose whatsoever, and in particular for advertising or commercial purposes, made from elements of the site without the prior written consent of the trademark owner is prohibited, in accordance with the provisions relating to the Protection of Intellectual Property.

The general structure of the site, the templates and frameworks used, as well as the information, pictograms, photographs, images, texts, video sequences, whether animated with sound or not, and other documents making up the site or accessible on the site, are subject to the laws protecting intellectual property and are the property of UM6P Canada or third parties having authorized UM6P Canada to use them. This also applies to suppliers, subcontractors, partners and/or affiliated companies involved in the operation of the site.

In this respect, any reproduction, representation, adaptation, translation and/or transformation, in whole or in part, of the site or of one or more of its components, by any process whatsoever (including transfer to another site), without the prior written authorization of UM6P Canada, is prohibited, and would constitute a punishable infringement, likely to incur the civil and/or criminal liability of its author. No license, nor any right other than that of consulting the site, is granted to anyone with regard to intellectual property rights.

By personal data, UM6P Canada refers to all information disclosed by users as natural persons, regardless of their nature, such as surnames, first names, e-mails, passwords enabling them to be identified directly or otherwise, whether supplied voluntarily by the latter or collected in the course of their navigation.

Any personal data collected by UM6P Canada is intended exclusively for use by UM6P Canada's Communications Department to enable the user to benefit from the services offered.

Any personal data that the user may transmit to UM6P Canada is subject to the provisions relating to the protection of individuals with regard to the processing of personal data.

No personal information regarding the user is passed on to third parties or used for unintended purposes.

Users of the site are required to comply with legal provisions. To this end, they must refrain from collecting, capturing, distorting or using the information they access and, in general, from any act likely to infringe on the privacy of individuals.

The user has the right to access, modify, rectify and delete any personal data relating to him or her that UM6P Canada may collect, by contacting UM6P Canada at any time online in the “Contact” section, or by mailing UM6P Canada's Communications Department at the following addresses:

UM6P Canada formally declines all responsibility for the content of all sites to which it provides links. These links are offered to users of the site or the related websites of the schools and affiliates as a complementary service. The decision to activate these links rests exclusively with the users of the site.

As UM6P Canada is not the publisher of these sites, it cannot fully control their content. As a result, UM6P Canada cannot under any circumstances be held responsible for the content of the sites thus accessible, and in particular for their accuracy, topicality, quality, completeness, relevance, illegality, advertising, information, products, services or any other material available on or from these sites or external sources.

Likewise, UM6P Canada shall not be held responsible for the collection and transmission of personal data, the installation of cookies or any other process designed to achieve the same ends, carried out on or by these sites.

The confidentiality and integrity of Information are not guaranteed on the Internet. Consequently, messages sent electronically by the user may be intercepted and/or modified. UM6P Canada declines all responsibility in this regard.

Users of the site may under no circumstances set up a hypertext link or framing (an example of HTML code programming) without UM6P's prior written authorization. Consequently, no element appearing on a page may be partially or totally distributed, transferred or inserted on another website, nor be used to create derivative products, without UM6P Canada's prior express authorization. The “www.UM6P.ma” site, the legal notices and these terms of use are all subject to Canadian law in the province of Quebec. In the event of a dispute relating to the interpretation or execution of the site, the legal notices and the terms of use, the Canadian courts shall have exclusive jurisdiction, unless otherwise provided by mandatory law.
